Article 1: Duration, Use, and Type of Membership

When you become a member of Patrick’s Gym, your membership is valid for an indefinite period. The number of visits included in a specific membership must be used within the applicable duration. Any unused visits after this period will expire.
The validity of a punch card depends on the type of punch card purchased. The membership agreement applies only to the specified activities, duration, price, and number of visits. Unless explicitly stated otherwise, membership is strictly personal and non-transferable.

Article 2: Cancellation

Cancellation of membership must be done in writing via email (info@patricksgym.com), at the front desk, or through the app. All memberships have a one-month notice period. If you do not cancel on time, your membership will automatically be renewed for the duration of your current membership. The notice period starts on the 1st of the following month.
Example: If you want to cancel by April 1st, you must submit your written cancellation before March 1st of the same year.

Article 3: Membership Suspension

If you are unable to use the gym facilities due to injury or illness, you may request a membership suspension of up to one (1) month by submitting a valid medical certificate from a registered physician (including name, practice, and BIG-registration number). The certificate must confirm that you are medically unfit for physical activity, but should not disclose your diagnosis or medical history.

Requests for suspension longer than one month require prior consultation and approval from Patrick’s Gym management.

In the case of pregnancy-related limitations, a simple pregnancy statement may be submitted.

Membership suspension requests must be made in advance and cannot be applied retroactively. Patrick’s Gym reserves the right to verify the authenticity of any medical certificate received.

Article 4: Opening Hours & Rates

Patrick’s Gym reserves the right to modify opening hours, class schedules, and rates, as well as apply inflation adjustments in accordance with the CBS Consumer Price Index. You will be notified in writing or via email at least two months before a rate change takes effect.
On official holidays, Patrick’s Gym reserves the right to close the gym without any reduction in membership fees or refunds.

Article 5: Payment Obligation

Membership fees must be paid on time and before the agreed (start) date of the membership. If payment is not received, Patrick’s Gym reserves the right to postpone the start date until payment is made.
For memberships, Patrick’s Gym may demand full payment of any outstanding amounts in one installment. Any legal and/or extrajudicial collection costs are your responsibility. If you wrongly reverse a membership payment, a €10 charge will be applied for each occurrence until payment is settled.

Article 6: Training Conditions and Class Schedules

General: You must always register for fixed class times. Training sessions are conducted under the supervision of a trainer unless otherwise stated. Each class has a maximum number of participants. If you are unable to attend, you must cancel your reservation in advance.

Group Classes: If your attendance in a fixed class falls below 50% within a quarter, Patrick’s Gym reserves the right to move you to a different time slot without any reduction in membership fees or refunds.

Article 7: Timely Cancellation of Personal Training

If you are unable to attend a personal training session, you must reschedule or cancel at least 24 hours in advance. If no timely contact is made, the session will be forfeited.

Article 8: House Rules

By signing the membership agreement, you agree to comply with the house rules established by Patrick’s Gym. Patrick’s Gym reserves the right to deny access to individuals who do not comply with the rules for a specified period, without the right to a refund.

Article 9: Clothing and Instruction Requirements

Proper sportswear must be worn in the gym. Jewelry is not allowed, and chewing gum is prohibited. During technique classes, boxing gloves, a mouthguard, and shin guards are mandatory. Sparring without trainer supervision is not permitted. Kickboxing sessions must be done barefoot. For Strength & Conditioning classes, clean sports shoes and a towel are required. Sports bags and other belongings must be stored in lockers or designated racks.

Article 10: Liability

The use of facilities at Patrick’s Gym is at your own risk. Patrick’s Gym is not liable for accidents, theft, fire, or other damages unless caused by intent or gross negligence. You acknowledge that exercising involves risks and accept these risks. Additionally, you indemnify Patrick’s Gym against any third-party claims.

Article 11: Personal Data and Privacy (GDPR)

Patrick’s Gym processes personal data because you use our services and/or provide this information yourself. Your data is processed for:

  • Sending newsletters and/or promotional materials.

  • Informing you about changes to services and products.

  • Enabling account creation.

Patrick’s Gym does not sell your data to third parties and only provides it when necessary for contract execution or to comply with legal obligations. After your membership ends, your personal data will be removed from the marketing database. For administrative and legal purposes, data will be retained for the required legal period.

Article 12: Multimedia

Patrick’s Gym reserves the right to use photos and videos taken in the gym for social media, the website, flyers, DVDs, and promotional purposes. If you do not wish to be included, you must notify us in writing when you join. If unwanted footage is accidentally used, we will remove it upon request.

Article 13: Other Provisions

In cases not covered by these terms, the management of Patrick’s Gym will decide.

Qlife Studio V.O.F. processes your personal data because you use our services and/or because you provide this data to us. Below is an overview of the personal data we process:

Special and/or Sensitive Personal Data

Our website and/or services are not intended to collect data from visitors under the age of 16 unless they have permission from a parent or guardian. However, we cannot verify whether a visitor is over 16. We encourage parents to be involved in their children’s online activities to prevent the collection of data without parental consent.

If you believe that we have collected personal data about a minor without proper consent, please contact us at info@patricksgym.com, and we will delete this information.

Purposes and Legal Basis for Data Processing

Qlife Studio V.O.F. processes your personal data for the following purposes:

  • Processing your payment

  • Sending our newsletter and/or promotional materials

  • Calling or emailing you when necessary to provide our services

  • Informing you about changes to our services and products

  • Delivering goods and services to you

  • Analyzing your behavior on our website to improve it and tailor our offerings to your preferences

Fitness Tracker

In our apps, you can choose to share your health metrics with us. These include data such as step count, weight, sleep patterns, and daily calorie intake. This data is securely stored on our server and can be deleted by you within the app.

By sharing this data in the app, your coach can provide guidance to help you achieve your fitness goals. If you do not have a coach at your club, you can use this data to track your own progress.

Important to know: We do not share this data with third parties. All data remains within the fitness program we use and is transmitted and stored securely. If you wish to disable access, you can do so via the app. Your shared data will then be deleted within one week.

Automated Decision-Making

Qlife Studio V.O.F. does not make decisions based on automated processing that could have significant consequences for individuals. This means that all decision-making involves human intervention.

How Long We Retain Personal Data

Qlife Studio V.O.F. does not store your personal data longer than strictly necessary to achieve the purposes for which it was collected. This means that data is deleted immediately once it is no longer required for its intended purpose.

Sharing Personal Data with Third Parties

Qlife Studio V.O.F. only shares personal data with third parties when necessary for executing our agreement with you or to comply with legal obligations.

Accessing, Modifying, or Deleting Data

You have the right to access, correct, or delete your personal data. Additionally, you have the right to withdraw your consent for data processing or object to the processing of your personal data by Qlife Studio V.O.F. You also have the right to data portability, meaning you can request that we send the personal data we have about you to you or a third party of your choice in a structured, commonly used format.

You can send a request for access, correction, deletion, data transfer, withdrawal of consent, or objection to the processing of your personal data to info@patricksgym.com.

To ensure the request is made by you, we ask you to include a copy of your identification document. Please black out your photo, MRZ (machine-readable zone, the strip of numbers at the bottom of the passport), passport number, and Citizen Service Number (BSN) to protect your privacy. We will respond as soon as possible, but within four weeks.

How We Secure Personal Data

Qlife Studio V.O.F. takes the protection of your data seriously and implements appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized modifications. We do this by:

  • Using an SSL certificate; all traffic between you and us is encrypted and cannot be intercepted

  • Securely storing cookie data in the administrative system

  • Conducting regular (at least monthly) security checks on our websites to quickly identify and resolve potential vulnerabilities

  • Making periodic backups of data, which are securely stored and not retained longer than necessary
